5th Circuit grants speedy appeal in CSE vs Bryant. Issues stay.

On Wednesday, the 5th U.S. Circuit Court of Appeals granted the state’s request for a speedy appeal. Further, the Court issued a stay pending appeal (meaning marriage equality will remain in limbo until the appeal is heard and a decision from the court is made).

The appeals court said that its same panel of three judges who will hear arguments about gay marriage appeals from Texas and Louisiana has also been assigned the Mississippi case.

CSE vs Bryant currently is not scheduled to be heard alongside Texas’ and Louisiana’s marriage equality cases. It’s currently unknown if that might change based on the expedited appeal for the MS case.

In light of the Court order granting the motion to expedite the appeal, the briefing schedule will be as follows in this case:

  • Appellants’ brief due: December 19, 2014
  • Appellees’ brief due: December 24, 2014
  • Appellants’ reply brief due: January 2, 2015
