5th Circuit lifts stay; clerks must issue marriage licenses

The Fifth Circuit Court of Appeals on Wednesday lifted a stay that had caused confusion over whether Mississippi could begin allowing same-sex marriages. Attorney General Jim Hood has ordered all circuit clerks to begin issuing same-sex couples marriage licenses immediately.

“Obergefell, in both its Fourteenth and First Amendment iterations, is the law of the land and, consequently, the law of this circuit and should not be taken lightly by actors within the jurisdiction of this court.”
